About these Terms
These Terms of Service (the “Terms”) form an agreement between you and RunStart (“RunStart,” “we,” “us,” or “our”) concerning your access to and use of the RunStart mobile application, website, and related services.
By downloading, accessing, or using RunStart, you agree to these Terms. If you do not agree, do not use RunStart. Your license to the application is also governed by Apple’s Standard Licensed Application End User License Agreement, as explained in section 13.

What RunStart does
RunStart is designed to help you begin a walk or run. You can schedule an alarm, choose a short target distance, and attempt a GPS- and motion-verified mission when the alarm rings. RunStart focuses on getting you moving; it is not a complete workout tracker, professional coaching service, medical service, or emergency alert system.
Available schedules, target distances, measurement units, and mission conditions may vary by app version, device settings, and the options shown in RunStart.

Eligibility
You must be at least 18 years old to use RunStart. RunStart is not intended for anyone under 18.

No RunStart account
The current version of RunStart does not provide a RunStart-operated user account, password, cloud profile, or RunStart-operated cross-device synchronization. Your Apple Account is separate from RunStart and is used by Apple for App Store purchases and subscription management.

Device requirements and permissions
RunStart depends on compatible Apple hardware, supported iOS functionality, and permissions such as alarm authorization, Precise Location, Motion & Fitness, background location where permitted by iOS, and notifications. Features may be unavailable or unreliable if these requirements are not met or permissions are changed.
If you grant notification permission, RunStart may provide local notifications and reminders related to your use of RunStart. Notification delivery depends on iOS and is not guaranteed. You can manage notification permission through device settings.

Alarms and missions
RunStart allows you to schedule an alarm and attempt a walking or running mission. A mission must be completed within the applicable completion window used or shown by RunStart. A temporary pause does not necessarily extend the mission’s original deadline. An expired or incomplete mission may be recorded as missed.
Alarms and notifications may fail, be delayed, not sound, not remain audible, or not be noticed because of device settings, permissions, battery state, focus modes, operating-system behavior, hardware conditions, or other factors outside our control.
RunStart should not be relied upon as an emergency or safety-critical alarm system. You remain responsible for maintaining a separate reliable alarm or reminder for medication, travel, work, appointments, emergencies, and other safety-critical or time-critical obligations.

Location and movement verification
With your permission, RunStart may use precise location and Motion & Fitness information during eligible active missions, including background location functionality where permitted by iOS, to assess walking or running progress.
GPS and motion signals can be unavailable, delayed, or inaccurate. Genuine walking or running may sometimes fail to count. RunStart may reject, limit, or delay poor-quality, implausible, vehicle-like, or otherwise ineligible movement. The distance RunStart records may differ from another device, application, or measurement.
Mission results are application-generated measurements used to operate RunStart. They are not an independent certification of exact physical distance or activity.

Safety
You are responsible for deciding whether, where, and when it is safe and appropriate to walk or run. Consider traffic, road conditions, terrain, weather, lighting and surroundings, local laws and rules, device distraction, and your health and physical condition. Stay aware of your environment and do not interact with your device in a distracting or unsafe manner, including while driving or operating a vehicle.
RunStart is not a medical device, healthcare service, or emergency service. It does not assess whether exercise is medically appropriate for you and does not provide medical advice, diagnosis, or treatment. Seek advice from a qualified professional if you have concerns about physical activity, and stop exercising and seek appropriate help if you experience concerning symptoms.

First free RunStart and paid access
RunStart may provide eligible new users with one qualifying completed RunStart without a paid subscription. The entitlement is used only when a qualifying mission is successfully completed and recorded by the application. Eligibility and any applicable scheduling conditions are shown in RunStart.
After that entitlement is used, paid functionality requires a valid subscription entitlement returned by Apple.

Annual subscription, trial, cancellation, and refunds
RunStart offers paid access through an annual auto-renewable subscription. The annual subscription price, currency, taxes, billing terms, and other purchase information displayed by Apple when you confirm the purchase apply and control.
Where shown in RunStart or Apple’s purchase flow, Apple-eligible users may be offered a 7-day introductory free trial. A trial is not available to every user. An eligible annual subscription converts to a paid subscription according to Apple’s displayed purchase terms unless cancelled through Apple before renewal.
Purchases are processed through the App Store using StoreKit. You can manage or cancel the subscription through your Apple Account. Deleting RunStart does not cancel it. Restore Purchases restores access only when Apple returns a valid, verified entitlement. Refund requests are handled through Apple’s applicable process, subject to any mandatory rights under applicable law.

Acceptable use
To the extent permitted by applicable law, you must not use RunStart unlawfully; interfere with or disrupt RunStart; circumvent subscription or entitlement controls; intentionally manipulate mission-verification mechanisms; copy, modify, distribute, or sublicense RunStart without authorization; reverse engineer proprietary portions of RunStart except where applicable law or applicable open-source licences expressly permit it; or use RunStart in a way that infringes the rights of others.

Intellectual property
RunStart’s software, branding, interface, graphics, mascot, animations, copy, and other proprietary materials are owned by or licensed to RunStart and are protected by applicable intellectual-property laws.
You may not copy, modify, distribute, sublicense, or attempt to derive source code from these materials without authorization, except as permitted by applicable law, Apple’s licence terms, or applicable third-party and open-source licences. Third-party and open-source materials remain subject to their respective licences.

Apple and third-party services
The RunStart application is licensed, not sold. Your licence to use it is governed by Apple’s Standard Licensed Application End User License Agreement (the “Apple Standard EULA”). These Terms supplement that EULA with RunStart-specific service terms. If there is a conflict concerning the scope of the application licence, the Apple Standard EULA controls.
RunStart relies on Apple services and iOS functionality, which may include the App Store, StoreKit, AlarmKit, Core Location, Core Motion, and notifications. Apple services are governed by Apple’s agreements and may change or become unavailable. Apple is not responsible for RunStart’s obligations under these Terms.

Privacy and local device data
Certain application information is stored primarily on your device. RunStart does not currently provide RunStart-operated cloud backup or cross-device synchronization. Local data may be lost, changed, restored, or otherwise affected by deleting or offloading the app, changing devices, restoring backups, or Apple and device-management behaviour.

Availability and changes to RunStart
RunStart is available only in countries and regions where it is offered through the Apple App Store and where its use is lawful. We do not promise that RunStart or every feature will be available in every location, language, device configuration, or operating-system version.
We may modify, update, suspend, or discontinue RunStart or particular functionality where reasonably necessary, including for safety, technical, legal, App Store, operational, or product reasons. Any effect on an active App Store subscription or entitlement remains subject to Apple’s systems, applicable law, and mandatory consumer rights.

Disclaimers
To the maximum extent permitted by applicable law, RunStart is provided on an “as is” and “as available” basis. We do not guarantee alarm or notification delivery; GPS or Motion & Fitness availability or accuracy; recognition of genuine movement; preservation of mission history or other local data; uninterrupted or error-free operation; or any particular behavioural, health, or fitness outcome.
Nothing in these Terms excludes, restricts, or modifies any statutory guarantee, remedy, mandatory consumer protection, or other right that applicable law does not allow us to exclude, restrict, or modify.

Limitation of liability
To the maximum extent permitted by applicable law, RunStart is not liable for indirect, incidental, special, or consequential loss arising out of or relating to RunStart or these Terms, including loss connected with missed alarms or notifications, unavailable features, inaccurate or rejected sensor measurements, local data loss, device conditions, or third-party services.
Subject to any liability that cannot lawfully be limited, our total aggregate liability arising out of or relating to RunStart or these Terms will not exceed the total amount actually paid by you for RunStart during the 12 months immediately preceding the event giving rise to the claim, or, if you paid no amount during that period, US$50.
Nothing in this section limits any liability, remedy, statutory guarantee, or mandatory consumer right that applicable law prohibits from being limited or excluded.

Ending your use
You may stop using RunStart at any time. Deleting the application does not automatically cancel an App Store subscription; cancellation must be handled through your Apple Account. Expiry, cancellation, or revocation of an entitlement may disable paid functionality. There is currently no RunStart-operated account to close.

Changes to these Terms
We may update these Terms for legal, regulatory, operational, or product reasons. Updated Terms will show a new effective date. We will provide additional notice or obtain consent where required by applicable law.

Governing law, informal disputes, and consumer rights
These Terms are governed by the laws of Malaysia, excluding its conflict-of-law rules, except where mandatory laws applicable to you provide otherwise.
If a concern arises, please contact RunStart first so we can try to resolve it informally and in good faith. Nothing in these Terms deprives you of mandatory consumer protections available under applicable law.

Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
