About these Terms
These Terms of Service (the “Terms”) form an agreement between you and Ooi Aik Keat, the individual operator of RunStart (“RunStart,” “we,” “us,” or “our”), concerning your access to and use of the RunStart mobile application, website, and related services.
By downloading, accessing, or using RunStart, you agree to these Terms. If you do not agree, do not use RunStart. Your license to the application is also governed by Apple’s Standard Licensed Application End User License Agreement, as explained in section 11.

Eligibility and parental permission
You must be at least 13 years old to use RunStart. If you are below the age of majority where you live, you may use RunStart only with the permission of a parent or legal guardian.
RunStart does not currently perform age verification. You are responsible for providing accurate information about your eligibility and for obtaining any permission required in your jurisdiction.

What RunStart does
RunStart is designed to help you begin a walk or run. You can schedule an alarm, choose a short target distance, and attempt a GPS- and motion-verified mission when the alarm rings. RunStart focuses on getting you moving; it is not a complete workout tracker, professional coaching service, medical service, or emergency alert system.
Available schedules may include one-time, daily, and selected-weekday schedules. Schedules can be enabled or disabled. Available target distances and units may vary by app version and device settings.

Alarms, missions, pauses, and movement verification
A mission has an original 30-minute completion window measured from its scheduled or trigger time. Tapping Start Run begins or continues the mission flow; it does not itself complete the mission. A mission completes only when RunStart records that the selected target distance has been reached through accepted movement.
RunStart may allow temporary pauses. A pause quiets the current alarm and may schedule it to return, but it does not extend the original 30-minute window. If that window expires before completion, the mission may be recorded as missed even if it is paused.
RunStart combines location and Motion & Fitness signals to assess walking or running progress. It may reject, limit, or delay distance that appears to result from stationary GPS drift, stale or poor-quality readings, unrealistic movement, insufficient motion evidence, or vehicle-like speed. Genuine movement may sometimes fail to count, and displayed distance may differ from another device or service.

Permissions and device conditions
RunStart depends on a compatible iPhone, supported operating-system features, and permissions such as alarm authorization, Location Services with Precise Location, and Motion & Fitness. Mission-related location and motion tracking is used during an active mission and stops when the mission reaches a terminal state or its original window expires.
Regular notification permission is separate from alarm permission and may be used for optional local trial or re-engagement reminders. Device settings, permission changes, battery state, focus modes, connectivity, operating-system behavior, hardware conditions, or other factors outside our control may affect alarms, notifications, location updates, purchases, and other features.

Safety and health
You are responsible for deciding whether, where, and when it is safe and appropriate to walk or run. Consider traffic, weather, terrain, lighting, your surroundings, local laws and restrictions, and your personal health and physical condition. Stay aware of your environment and do not allow an alarm, screen, or mission to distract you from immediate hazards.
Do not interact with or operate RunStart in an unsafe manner while driving or operating a vehicle. Vehicle travel is not valid walking or running progress.
RunStart does not provide medical advice and does not diagnose, treat, cure, or prevent any medical condition. If you have concerns about whether exercise is appropriate for you, seek advice from a qualified professional. Stop exercising and seek appropriate professional help if you experience concerning symptoms.

Your first completed RunStart is free
New users receive one completed RunStart without a subscription. The free entitlement is consumed only when a mission is successfully completed and recorded as completed. It is not consumed merely by scheduling an alarm, an alarm triggering, tapping Start Run, pausing, encountering GPS problems, missing or allowing a mission to expire, or closing the app before completion.
The first-free setup uses a one-time schedule within the next 12 hours. Because the entitlement is stored locally, damaged or inconsistent device data may require support review where practical.

Annual subscriptions and free trials
After your first completed RunStart, an active annual auto-renewable subscription is required to schedule or begin additional missions. RunStart may offer a seven-day free trial to users whom Apple reports as eligible. Apple determines eligibility for introductory offers.
The price, currency, applicable taxes, annual billing period, trial eligibility, trial conversion, and renewal information shown by the App Store when you confirm a purchase are authoritative. Review that information before purchasing. Your subscription renews automatically unless it is cancelled according to Apple’s applicable subscription rules.

Cancellation, restoration, and refunds
Apple processes RunStart subscriptions and manages payment, renewal, cancellation, and verified entitlement information. You can manage or cancel a subscription through your Apple Account subscription settings. The timing and effect of cancellation are governed by the information shown by Apple and Apple’s applicable terms.
If an active subscription is not recognized, you may use Restore Purchases. RunStart will ask Apple to synchronize purchases and will restore subscription access when Apple returns a verified, active entitlement.
RunStart does not operate its own App Store refund system. Purchase and refund requests are handled through Apple, and refund eligibility is governed by Apple’s applicable policies and any mandatory consumer law that applies to you.

Acceptable use
You must use RunStart lawfully, safely, and consistently with these Terms and Apple’s applicable usage rules. You must not deliberately manipulate, bypass, falsify, interfere with, or attempt to defeat RunStart’s movement-verification, entitlement, alarm, or purchase-restoration systems.
RunStart may decline to count movement or record completion when the available signals do not satisfy its verification rules. This is an outcome of the verification process and does not imply that RunStart operates a remote account-ban or user-suspension system.

Apple Standard EULA and intellectual property
The RunStart application is licensed, not sold. Your license to use the application is governed by Apple’s Standard Licensed Application End User License Agreement (the “Apple Standard EULA”). These Terms supplement the Apple Standard EULA with RunStart-specific service, subscription, safety, mission, and acceptable-use terms. If there is a conflict concerning the scope of the application license, the Apple Standard EULA controls.
RunStart, including its software, visual design, text, graphics, robot artwork, and other materials, is owned by or licensed to Ooi Aik Keat and is protected by applicable intellectual-property laws. No rights are granted except those provided by the Apple Standard EULA, these Terms, or applicable law.

Privacy and local device data
RunStart currently stores settings, onboarding choices, alarm information, subscription-access state, and mission records—including location-derived mission information—locally on your device. RunStart does not currently provide a RunStart account, cloud backup, or cross-device synchronization.
Apple separately processes App Store purchases and related account information under Apple’s terms and privacy practices. RunStart’s handling of information is described in the Privacy Policy. These Terms do not promise account deletion, complete data deletion, data export, cloud backup, or synchronization features that are not implemented.

Service availability, changes, and discontinuation
RunStart is available only in countries and regions where it is offered through the Apple App Store and where its use is lawful. We do not promise that RunStart or every feature will be available in every location, language, device configuration, or operating-system version.
We may modify, update, suspend, or discontinue RunStart or particular functionality where reasonably necessary, including for safety, technical, legal, App Store, or product reasons. Any effect on an active App Store subscription or entitlement remains subject to Apple’s systems, applicable law, and mandatory consumer rights. This provision does not claim that RunStart currently operates a remote account-suspension or account-ban system.

Warranties and service limitations
To the extent permitted by applicable law, RunStart is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free availability, perfect GPS accuracy, perfect Motion & Fitness classification, that every genuine movement sample will count, or that every alarm or notification will always be delivered, noticed, or operate under every device condition.
Nothing in these Terms excludes, restricts, or modifies a guarantee, warranty, condition, remedy, or other consumer right that applicable law does not allow us to exclude, restrict, or modify.

Limitation of liability
To the extent permitted by applicable law, Ooi Aik Keat is not liable for indirect, incidental, special, or consequential loss that is not reasonably attributable to RunStart’s breach of these Terms or failure to exercise reasonable care. This includes losses arising from missed alarms or notifications, unavailable features, sensor inaccuracies, rejected movement, device conditions, or third-party services where such losses were not reasonably attributable to RunStart.
This section does not limit liability, remedies, or rights that cannot lawfully be limited, including mandatory consumer protections. It also does not reduce your responsibility to use RunStart safely and to remain aware of your surroundings and physical condition.

Changes to these Terms
We may update these Terms to reflect changes to RunStart, Apple requirements, applicable law, or our practices. The updated Terms will show a revised effective date. Where required for a material change, we may provide reasonable notice through the app, the website, or another appropriate method. We do not promise a particular notice method where it is not implemented or legally required.
If you continue using RunStart after updated Terms take effect, the updated Terms will apply to your continued use, subject to any consent or notice requirements imposed by applicable law.

Governing law and disputes
These Terms and the RunStart-specific service relationship are governed by the laws of Malaysia, without removing any mandatory rights or protections you have under the law that applies to you.
If a concern arises, please contact us first so we can try to resolve it informally and in good faith. If it cannot be resolved, either party may bring the dispute before a competent court in Malaysia, subject to any mandatory right you may have to bring a claim in another court or consumer forum. These Terms do not require mandatory arbitration and do not contain a class-action waiver.
